Court decisions on costs in civil procedure

The object of this thesis is to capture the issue of court decisions on costs of civil proceeding. The purpose of the work is to take possible solutions whose application could lead to subsequent improvement of courts'desicions on costs and simplifying the decision making process. Furthermore, legislation in the Czech Republic is beeing analyzed. Apart from that, the thesis deals itself with the basic principles of decisions on the costs supported by case law which can be applied in judicial practice. Attention is also focused on theoretical questions of costs - the types of costs, the issue of legal fees, compensation of costs, decision making process, procedural economy and the bill of costs. Apart from that the subject of my interest are specific cases from practice courts, which are legally interesting or controversial. In addition to that, I pursue the field of legal aid, which is compared with its equivalents in the Federal Republic of Germany and Slovak Republic.
Court fees in the administrative justice system focused on problems in application

The purpose of my thesis is to analyze the current system of court fees in regards to administrative justice. The goal of this work is to find difficulties that occur within its application and to provide an easy well-arranged outlook on answers to these difficulties. The inspiration for the nature of this analysis is the fact that no such work has been focused on these issues and the application methods. My thesis itself is composed of six separate chapters with each chapter corresponding to an ideal or aspect of administrative justice. The first chapter is wholly introductory in nature, while the second chapter covers basic terminology associated with this process. While the third chapter deals with the historical elements and evolutionary process of the system of court fees in administrative justice. Composing the main body of my thesis or fourth chapter in this selection, is my analysis of the current legal system of court fees in administrative justice and the main difficulties associated within its application. Chapter five consists predominantly of my personal reflections and my notions as to how the system may be improved. Decisions on the award and amount of costs in civil proceedings Abstract This thesis deals with the issue of costs of civil proceedings. The scheme of the thesis follows the scheme of the Code of Civil Procedure and is supplemented by references to judicature, in particular the Constitutional Court's judicature. It deals almost exclusively with costs of proceedings at the first-instance procedure. The thesis in its introduction highlights the importance of the issue of costs of proceedings and the significant impact of the cost statement on the individual parties involved. It sets out the basic distribution of costs for general and special costs and lists their basic functions, ie the preventive and sanctioning function. The introduction also describes the role of the Constitutional Court in relation to costs of proceedings. After a short introduction to the issue of costs of proceedings, the list of the types of costs, their description, their functions and legal regulations are listed. More capacity is devoted to the court fee and issues related to it. These include the amount and extent of the charge, the exemption (and its types) from the payment of the court fee as an expression of the right to judicial protection and others. Court fees in civil proceedings - abstract This thesis as its name suggests is dealing with court fees in Czech civil proceedings. The aim of it is especially to describe institute of court fees, indicate procedure of courts in this area in civil proceedings, point to difficulties arising in praxis and to propose its solutions. That all in view of court clerk who operates with court fees most often. The author of this thesis works as an assistant of judge at district court, so he's supposed to be well orientated in this matter. The thesis is divided into three basic parts. The first one is dealing with court fees generally. At first it is explained the term, object and especially functions of court fees continuing by the chapter about sources of law relating to court fees. Then the general elements have turn. It is described who is fee-payer and when the fee obligation occurs. The second part is concerning with institution of exemption from paying court fees, both individually by judicial decision and directly by law. Cost effectiveness in the Czech judiciary

This thesis deals with the cost-effectiveness in the Czech judiciary. The theoretical part includes lessons learned from the literature with related to the topic. These information is also used in the practical part of this work. The theory deals with the management of court in the general scale, there is also described the history of the Czech judiciary, financial security functioning judiciary, management of regional and district courts and a possible solution to improve the situation in the Czech justice. The practical part is focused on a particular court in the Czech Republic. There is a relatively detailed Court described the financial situation in a particular year, compared with previous years and the total evaluation of the collected information.
